Chapter 1 Overview
1.1 onecar4u.com website is a Public Domain offered and administrated by OneCar4U Serv trading company, hereinafter referred to as “OneCar4U”.
1.2 onecar4u.com website operates as a worldwide data base of all the commercial cars (new or second hand) and vans (new or second hand) sale advertisements published and stored thereon.
1.3 “Commercial cars” means the self-propelled cars suspended on wheels, caterpillars or sliding soles, used for passengers or goods transportation.
1.4 The natural or legal persons may publish cars and vans sale advertisements on onecar4u.com, and may also look for any car sale advertisement stored in the database.
1.5 Each onecar4u.com Public Domain user shall observe the “Terms and Conditions” herein, both for the search facilities and advertisement publishing.
1.6 OneCar4U provides all the onecar4u.com users only with the necessary technical support to publish the sale advertisement without modifying their content in any way.
1.7 OneCar4U has no liability whatsoever related to the commercial and legal relationship between the trader (seller) and the buyer.
1.8 The sale-purchase agreements pursuant to an advertisement published on onecar4u.com shall be concluded and executed without any implication from OneCar4U.
Chapter 2 Services Offered
2.1 Advertisement publishing
OneCar4U provides all onecar4u.com users with a form for the online publishing of a cars and vans sale advertisement (see Chapter 4).
Thus, the user who has published a sale advertisement on onecar4u.com agrees upon its translation into other languages than the original one.
2.2 Searching for advertisements
OneCar4U provides all the onecar4u.com users with the database in order to look for the for-sale cars and vans.
OneCar4U undertakes the right of restricting the car sale advertisements and the access to the database on onecar4u.com, in case of maintenance work or for the purpose of maintaining the servers’ safety.
OneCar4U shall inform all the registered users (see Chapter 3) on the above-mentioned situations, in advance.
Chapter 3 Registration and User Account
3.1 In order to publish cars and vans sale advertisements on onecar4u.com any natural or legal person shall sign up thereon. This requires a valid e-mail address, a personal password as well as contact information (address, telephone, fax, etc.).
3.1 No user may have more than one account.
3.3 OneCar4U undertakes the right of deleting the user accounts that have not been active for more than one calendar year.
Chapter 4 Publication. Extension and Modification of the Cars and Vans Sales
Advertisement
4.1 Any signed-up user (see Chapter 3) is entitled to publish an unlimited number of cars and vans sale advertisements for maximum 30-calendar days. Each advertisement may be extended for 30-calendar day periods (see the prices on onecar4u.com).
4.2 OneCar4U undertakes the right to previously verify the sale announcement (before publishing) and shall validate it only if it meets the Chapter 7 conditions herein regarding the advertisements’ content and appearance.
4.3 The validity of a published or extended advertisement shall start up from its validation moment and shall end at 24.00 o’clock of the 30th day. Two days before the expiration of any advertisement’s validity, OneCar4U shall send out warnings to the user.
4.3 Once the validity of one advertisement expires, it shall be automatically erased from onecar4u.com database.
4.5 The modifications after advertisement publishing are free of charge.
4.6 Any user may erase its advertisement at any moment. In such cases, OneCar4U shall not reimburse the price for that advertisement totally or partially.
Chapter 5 Erase and Refusal to Publish the Advertisements, Restriction and Unilateral
Cancellation
5.1 Should a registered user breach the legal provisions or the “Terms and Conditions” herein (especially the requirements presented at Chapter 7), OneCar4U undertakes the right to proceed to the following measures:
- refusal of publishing the advertisements;
- erase the entire content of the advertisements;
OneCar4U shall notify that user both upon the undertaken decision and the reasons thereto.
5.2 OneCar4U undertakes the right to finally restrict a registered user’s right of publishing any advertisements on onecar4u.com, had that user recurrently preached the “Terms and Conditions” herein.
5.3 Any registered user is entitled to unilaterally cancel these “Terms and Conditions” and consequently may erase the onecar4u.com account.
Chapter 6 Modifications of the Advertisement Publishing Prices and Modifications or Supplements to the Terms and Conditions for using the onecar4u.com
6.1 Any modification of the advertisement publishing prices shall be published on onecar4u.com, and OneCar4U shall notify all registered users thereon by e-mail.
6.2 The new publishing prices shall apply as follows:
- to all new advertisements to be published after the notified new price effective date;
- only to the existing advertisements that shall be published after the effective date of the new price;
6.3 OneCar4U is entitled to unilaterally modify and/or supplement the onecar4u.com using “Terms and Conditions”. The modified and/or supplemented “Terms and Conditions” shall be notified to the users before publishing or extending the validity of an advertisement.
6.4 Any registered user has to accept the new “Terms and Conditions” in order to be able to continue publishing new advertisements or in order to be able to extend the validity of the existing advertisements.
6.5 The registered users who shall not accept the new “Terms and Conditions” shall be entitled only to maintain the existing advertisements.
Chapter 7 Advertisement Contents and Appearance
7.1 Any registered user (see Chapter 3) is allowed to publish one or several advertisements on onecar4u.com for any type of commercial cars (See Par. 1.3) and vans, only for sale purpose.
7.2 OneCar4U enables all registered users (See Chapter 3) to publish complete advertisements, also allowing him/her besides technical data and photographs, to upload a presentation video of the for-sale car.
7.2 The user is bound to publish a car’s sale advertisement under that particular car’s proper section (automotive, trucks, motorcycles, farming vehicles, construction vehicles) or under van section.
7.4 The seller is the sole responsible for the accuracy of the information (technical data) regarding the published vehicle, as well as for the seller’s contact data, OneCar4U shall have no liability thereto whatsoever.
7.5 Shall a sale advertisement be published under another section than the one specified in the advertisement title, or if the pictures or the presentation video (if applicable) does not present the category of vehicle in the advertisement title, OneCar4U undertakes the right of moving the advertisement into the section assigned for that vehicle, or as case may be, of refusing its publishing (See Chapter 5). OneCar4U shall notify the user upon the modification or upon the refusal to publish the advertisement.
7.5 Publishing other advertisements than vehicle sale advertisement is not allowed.
7.5 Publishing pictures or videos presenting anything else than the for-sale vehicle is not allowed. The presentation pictures and videos must reflect the status of the for-sale vehicle on advertisement publishing date.
7.5 Publishing catalogue and/or car show pictures is not allowed.
7.6 Publishing the same advertisement on the sale vehicle, several times is not allowed.
7.6 Publishing links (external connections) to other websites or to other sources of information inside the advertisement is not allowed. The link to the seller’s website may be inserted and it is chargeable (see the prices on onecar4u.com).
Chapter 8 Liability Exoneration
8.1 OneCar4U is free from any liability related to the infringement of any third parties’ rights by onecar4u.com users publishing of advertisements thereon.
